Ebbs x Flows – Terms of Service

These Terms apply when you use the Ebbs x Flows website or purchase products from us.

Nothing in these Terms limits or excludes your statutory consumer rights.

1. About Ebbs x Flows

Ebbs x Flows is an independent UK streetwear business specialising primarily in authenticated pre-owned streetwear.

2. Using Our Website

You agree to use our website lawfully and not to interfere with its security, operation or functionality.

You must not knowingly introduce viruses or malicious code, attempt unauthorised access to the website or use the website for fraudulent or unlawful purposes.

3. Product Information

We aim to describe and photograph our products accurately.

Because many products are pre-owned, individual items may show signs of previous wear. Where relevant, condition information and significant known imperfections will be included within the product listing or explained through our Item Condition Guide.

Colours and appearance may vary slightly depending on your device or screen.

Nothing in these Terms affects your legal rights if goods are faulty, damaged, not as described or otherwise fail to meet the requirements of consumer law.

4. Mystery Tees

Mystery Tees and Mystery Tee Bundles intentionally keep certain characteristics of the product secret until delivery, such as the exact brand, colour, graphic or design.

The relevant Mystery Tee product page explains the possible brands, condition and other key characteristics before purchase.

Mystery Tees remain subject to our Returns & Refunds Policy, including applicable statutory cancellation rights.

5. Orders

When you submit an order, you are making an offer to purchase the products in your basket.

We will send an order confirmation electronically.

We may refuse or cancel an order where there is a reasonable reason to do so, for example suspected fraud, an obvious pricing or listing error, inability to fulfil the order or an item unexpectedly being unavailable.

If we cancel an order after taking payment and you are not at fault, we will refund the relevant amount paid.

If you wish to cancel an order, contact us as soon as possible. This does not affect any statutory cancellation rights described in our Returns & Refunds Policy.

6. Prices & Payment

Prices displayed on our website may change before an order is placed.

Once we have accepted your order, we will not change the agreed price of that order unless you agree to the change or the law allows it.

Any shipping costs will be shown during checkout.

For international orders, additional import duties, customs charges or taxes may apply depending on the destination. Please see our Shipping Policy for further information.

7. Delivery

We aim to dispatch orders within 1–2 business days.

Delivery estimates are provided in good faith but may occasionally be affected by circumstances outside our reasonable control.

Unless another delivery timeframe has been agreed, goods will be delivered without undue delay and within the period required by applicable consumer law.

We remain responsible for goods until they are delivered into your physical possession, or the possession of somebody you have identified to receive them, except where the law provides otherwise.

8. Returns, Cancellations & Refunds

Online purchases are subject to our Returns & Refunds Policy.

For eligible UK online purchases, you can notify us within 14 days of receiving your goods that you wish to cancel. You then have a further 14 days to return the goods.

Mystery Tees and Mystery Tee Bundles are included in this policy.

Your rights concerning faulty, damaged, incorrect or not-as-described goods are separate from the change-of-mind cancellation right and remain unaffected.

9. Authenticity

We take reasonable steps to authenticate the streetwear we sell and only list products that we are confident are authentic.

If you have concerns about the authenticity of an item you receive, contact us at contact@ebbsxflows.com so we can investigate.

Your statutory rights remain unaffected.

10. Intellectual Property

Unless otherwise stated, the Ebbs x Flows branding, website text, original graphics, photography and other original content created by us belongs to Ebbs x Flows or is used with appropriate permission.

You must not reproduce or commercially use our original content without permission where such use would infringe our rights.

Third-party brand names and trademarks belong to their respective owners.

11. Third-Party Services

Our website may use services provided by third parties, including Shopify, payment processors and delivery companies.

Where another company provides part of the service, this does not remove any responsibility that Ebbs x Flows has to you under applicable consumer law.

Links to external websites are provided for convenience and we are not responsible for the content of websites we do not operate.

12. Reviews & User Content

If you voluntarily submit a review, photograph, comment or other content to us, you confirm that you have the right to submit it.

Where you give us permission to repost or use that content, we may use it for Ebbs x Flows marketing and promotional purposes in accordance with that permission.

13. Website Errors

We aim to keep our website accurate and up to date.

If we discover an obvious error in a product listing, price or other information, we may correct it.

Where an error materially affects an order that has already been placed, we will contact you and deal with the order fairly, including offering a refund where appropriate.

14. Our Responsibility to You

Nothing in these Terms excludes or restricts liability where it would be unlawful to do so.

In particular, nothing in these Terms removes your statutory rights relating to goods that are faulty, not as described, not of satisfactory quality or otherwise fail to meet legal requirements.

We are not responsible for losses that could not reasonably have been foreseen when the contract was made, except where the law requires otherwise.

15. Privacy

Personal information is handled in accordance with our Privacy Policy.

Our store is hosted by Shopify and information may be processed by Shopify and other service providers as described in that policy.

16. Changes to These Terms

We may update these Terms from time to time.

Changes will apply to future use of the website and future orders. We will not use a later change to these Terms to remove rights that already apply to an order you have placed.

17. Governing Law

These Terms are governed by applicable UK consumer law.

If you are a consumer, nothing in these Terms prevents you from relying on any mandatory legal rights or bringing proceedings in a court available to you under applicable law.
